This Privacy Policy describes how Distribuciones Alimentarias El Pibe, S.L. collects, uses, protects, and shares personal data from its customers. “Customer” refers to any person who visits our restaurants, uses our website www.elpibe.es (hereinafter, the “Website”) or the ELPIBE mobile application (hereinafter, “ELPIBE” or the “App”), or otherwise interacts with us.

2. Purposes of Data Processing

DIALPI processes customers’ personal data for the following purposes:

  • Administrative and commercial customer management.

  • Handling and responding to inquiries submitted via our Website.

  • Managing recruitment processes and candidate relations.

  • Operating the ELPIBE mobile App and, where applicable, managing participation in the Club Pibelovers loyalty program (see Section 7).

  • Processing customer orders placed through the App.

  • Sending commercial communications, push notifications, emails, and SMS messages.

3. Legal Basis for Data Processing

The processing of your personal data may rely on your consent, an existing commercial relationship, legitimate interest, or another legal basis, specifically:
(i) Processing of customer data—including data collected via the App and Club Pibelovers enrollment—is based on performance of the contractual and/or commercial relationship and/or your consent.
(ii) Data processing necessary to manage and respond to inquiries submitted to DIALPI.
(iii) Processing of candidate data for job applications is based on your consent and the need to manage the application.
(iv) Sending commercial communications (push, email, SMS) is based on your consent and/or DIALPI’s legitimate interest.

4. Data Quality and Retention

DIALPI takes reasonable measures to ensure that personal data is accurate, complete, updated, and limited to the agreed purposes, based on the most recent information you provide. To update your data, please contact us using the details in Section 9.
Personal data will be retained only as long as necessary for the purposes for which it was collected or to address legal responsibilities, in accordance with applicable record‑keeping laws.

5. Data Recipients

Your personal data are processed internally by DIALPI. However, for proper service delivery, data may be shared with third parties as permitted by law, including but not limited to:

5.1. EL PIBE Group Entities
DIALPI may share your personal data with other entities within the EL PIBE Group (e.g. companies owning or operating EL PIBE restaurants or affiliated subsidiaries) solely to provide the services you contract through the App or Website.

5.2. Service Providers
Personal data may be transferred to service providers involved in:

  • App functionality and related services.

  • Technical infrastructure for the Website and App.

  • Payment processing — e.g. banks and external payment services — for order fulfillment, fraud prevention, and PCI DSS compliance.
    Such providers offer legally required guarantees, access only to necessary data, and are contractually restricted from processing your data for other purposes.

When transferring data internationally (e.g. to the U.S.), DIALPI ensures compliance with EU requirements via Standard Contractual Clauses and formal data‑processing agreements.

5.3. Public Authorities
Your data may be disclosed to competent authorities when required by law, regulation, or judicial order. DIALPI complies with all applicable data protection obligations.

6. Privacy Notice for Children

We do not collect personal data from children under 15 years old, except when a parent or guardian consents or provides data for a specific activity. Parents are advised to supervise their children’s online activity.

7. Specific Data Processing in the App

The legal basis for processing in connection with the ELPIBE App is the contractual relationship upon download, registration, or use, and/or your specific consent for certain purposes.
If you grant permission, we may collect your geolocation data to identify the nearest EL PIBE restaurant and to send push notifications.

To register, users must provide email address, password, first and last names—phone number is optional. For placing orders, you must also supply payment card information and postal address for home delivery.

By downloading the App and placing orders, you join the Club Pibelovers loyalty program. DIALPI processes data to allocate “Pibepuntos” based on purchases—this includes purchase history, visited restaurants, payment methods, amounts spent, points earned/redeemed, redeemed offers, and program access frequency. App usage and behavior data are gathered for statistical analysis and offer personalization.

Profile building through automated decision-making based on your consumption habits, product preferences, and App activity is used to personalize offers. For more details on profiling, you may contact lopd@elpibe.es. Uninstalling the App does not delete your user account—if you wish to remove your data, you must delete your account via your profile or request account deletion.

8. Social Media

Links to our Facebook, Twitter, and Instagram profiles are provided on our Website. DIALPI is the service provider under the LSSI (Article 10). We may access publicly visible data on users’ social media profiles, such as name, nickname, avatar, and other profile data.

Such data may be processed to manage user participation in promotions or to respond to messages received via social media. Generally, DIALPI does not extract or transmit users’ social media data to third parties; such data remains within the social media platform’s systems.

Legal basis: contractual necessity for managing promotional participation or inquiries submitted via social media. Personal data will be retained as long as necessary to fulfill legal obligations or to defend potential claims. We recommend you review each social platform’s privacy policy. For any data‑related questions, contact DIALPI as in Section 9.

9. Data Subject Rights

You may exercise your rights of access, rectification, erasure, and portability of your personal data, as well as restrictions or objections to processing (in whole or in part), in accordance with applicable law, by sending a written request to:
